Terms and Conditions
1. Contract Between Us
We must receive payment in full for the goods purchased before an order can be processed. Once payment is received, a confirmation email with your order invoice will be sent to you. Acceptance of your order brings into existence a legally binding contract between us.
2. Right to Refuse Order
We reserve the right to refuse or cancel any order for any reason, including but not limited to the following:
- Insufficient stock to meet the customer’s requirement
- We do not deliver to your area
- One or more items were listed at an incorrect price due to a typographical error or human misjudgement
If an order is refused, an email will be sent to the customer specifying the exact reason. If any payment has been deducted from your account, it will be fully credited back. Kilt Republic holds no financial obligation and will not provide compensation for any inconvenience caused.
3. Pricing
Prices for all goods are clearly listed on the website.
Additional charges may apply for delivery to certain areas or regions where shipping costs are higher.
All orders are processed in US dollars as displayed on the website. Conversions into other currencies are shown for convenience only and are approximate. Prices may change slightly between the date of placing the order and the date of dispatch.
4. Right of Customer to Cancel an Order
Customers have the right to cancel their order at any time before it is delivered. No justification, penalty, or fee is required for cancellation. However, cancellation is subject to the following conditions:
- The customer must notify us in writing
- A clear reason for cancellation must be provided
- If goods have already been received and the customer wishes to return them, the item must be sent back at the customer’s own risk and cost
Once we are notified of a cancellation, any amount paid will be credited back to your account. However, if a returned item arrives damaged or broken, the cost of that damage will be deducted from the refund amount.
5. Delivery of Goods
Delivery is made to the shipping address provided by the customer within the timeframe specified in our Shipping Policy. If the shipping address provided is incomplete or incorrect, Kilt Republic will not be liable for wrong or delayed delivery. The responsibility for providing an accurate address lies entirely with the customer.
Standard delivery times are 20–30 business days for kilts and 25–35 business days for kilt jackets. In rare cases, delivery may take longer.
Once goods are dispatched and a tracking number has been issued, ownership of the goods transfers to the customer. All risks and liabilities associated with the goods are transferred to the customer from that point. Kilt Republic will not be liable for any loss, destruction, or damage to goods after dispatch.
If a shipping carrier holds a parcel due to non-contact from the customer, and the parcel is subsequently returned, shredded, or destroyed, Kilt Republic will not be liable for that loss and will not provide compensation, as risk and ownership have already been transferred. We will, however, make every reasonable effort to contact the customer and request timely action.
6. Fraud Prevention
We may use the information you provide to conduct fraud prevention checks. That information may be disclosed to credit reference or fraud prevention agencies, which may keep a record of it.
We validate your name, address, and other relevant information against appropriate third-party databases during order processing. By accepting these terms and conditions, you consent to such checks being carried out. These checks are conducted solely to confirm your identity — no credit check is performed and your credit rating will not be affected. All information provided is held in strict accordance with the Data Protection Act 1998.
7. Notices
Unless otherwise stated in these terms and conditions, all notices from you to us must be in writing and sent to our official email address. All notices from Kilt Republic to you will be displayed on our website from time to time.
8. Events Beyond Our Control
Kilt Republic will not be liable for any failure to deliver goods, delays in delivery, or any damage or defect to delivered goods caused by events or circumstances beyond our reasonable control, including but not limited to: strikes, lock-outs and other industrial disputes, breakdown of systems or network access, flood, fire, explosion, accidents, or any other natural calamity.
9. Governing Law
The contract between us shall be governed by and interpreted in accordance with applicable law. Any disputes between us shall be subject to the jurisdiction of the relevant courts.
10. Entire Agreement
These terms and conditions, together with our current website prices, delivery details, contact details, and privacy policy, set out the whole of our agreement relating to the supply of goods to you by us. Except where you are dealing as a consumer:
- Nothing said by any representative on our behalf should be understood as a variation of these terms and conditions or as an authorised representation about the nature or quality of any goods offered for sale
- Save for fraud or fraudulent misrepresentation, we shall have no liability for any such representation being untrue or misleading
11. Images
All images displayed on the Kilt Republic website are professionally photographed and edited. Minor colour differences may exist between product images and the actual item received. Claims of misrepresentation on the grounds of colour will not be entertained. Minor colour variation due to image editing and optimisation for online use is standard practice.
12. Taxes & Duties
The customer is responsible for any taxes, duties, or import fees applicable to their order. While such charges are not common, if applied by your local customs authority, you are required to pay them. Kilt Republic has no control over these charges and cannot predict their value. Failure to pay applicable charges may result in delivery delays or the package being returned to us, for which Kilt Republic will not be held liable. If a package is returned due to non-payment of duties or taxes, any refund issued will exclude original shipping costs and any additional fees incurred.
